New York Law - What Other Factors Determine Child Support?

In addition to the guidelines, the court will consider the following factors in setting child support:

  • The financial resources of both parents.
  • The financial resources of the child.
  • The physical and emotional health of the child.
  • Educational needs of a child, including college, private schools, and summer camp.
  • The standard of living the child would have enjoyed had the marriage not been dissolved.
  • Tax consequences of alimony versus child support.
  • The non-monetary contributions each parent will make to the child's well-being.
  • The educational needs of either parent.
  • The relative incomes of the parties.
  • Child support that the payer is paying to children by prior marriages or other children who he or she is supporting.
  • Other resources available to support those children of prior marriages.
  • Extraordinary expenses of visitation.
  • Expenses the non-custodial parent has for extended visitation, to the extent that this reduces the custodial parent's expenditures.
