New York Law - If One Spouse Interferes With Visitation, May The Other Stop Making Payments?

If one spouse wrongfully interferes with or withholds visitation, the thwarted spouse must nonetheless pay child support -- at least for awhile.

But, the thwarted spouse may go to court to ask the court to suspend his or her requirement to pay child support in the future as long as the prevention of visitation continues.

Also, for alimony, the paying spouse can stop paying, if the custodial spouse prevents visitation with the children. If the court agrees with the paying spouse, the court may cancel the unmade back-payments and free the payer from having to make them. If the court disagrees with the paying spouse, then the paying spouse will have to make all the back payments.
