New York Law - When Can Child Support Awards Be Modified?

Either party may request that the court review a child support order 36 months (3 years) after the issuance of the order.

The court will then typically modify the child support awards whenever, under a calculation at that time, the child support order would change by 10% or more from the existing order.

Typical changes that would trigger modification include an include an increase or decrease in the income of either party.

These rules apply only if the support is being enforced through the Support Collection unit.

If the parties opted out of that enforcement mechanism, the court will modify the support order only on a showing of a material change in circumstances.
