New York Law - Is This A "No-Fault" Divorce State? New York is a no-fault divorce state, as long as both parties agree to the divorce. This means that, where both parties want a divorce, they do not have to show a specific misbehavior on the part of the other spouse, such as adultery, abandonment, drunkenness or addiction, abuse, etc. They simply have to state that there is no chance the marriage will be patched up, and that is sufficient grounds for a divorce. However, for divorces by mutual consent, there is a waiting period of at least one year after the filing of the separation document. Sec 170.1, 171.
