New York Law - Can One Party Alone Bring About a Divorce? In New York, there is no process for granting a no-fault divorce where only one party wants the divorce. If only one party wants the divorce, that party must appear before the judge and convince the judge that one of the fault-based grounds for divorce has occurred. In most cases, though, the parties do end up ultimately agreeing to the divorce. Sec. 170.1, 171.
