New York Law - Is There a Minimum Waiting Period After Filing? Unlike several states, New York does not formally have a minimum waiting period between the date the divorce is filed and the date the divorce may be granted. However, for divorces by mutual consent, there is a waiting period of at least one year after the filing of the separation document. And divorces for cause will generally take quite a while to be heard and adjudicated. So, in practice, parties will typically wait at least a year between the filing for divorce and the actual granting of the divorce. Section 170.
