New York Law - The Home

The court is authorized to consider whether the custodial parent should be awarded the home outright, or given the right to live there for a period of years.

Courts do in practice prefer that the custodial parent remain in the home, unless the spouse can not afford to keep home, or the spouse can afford other housing, or either spouse needs the money the sale of the home would bring in order to live.

Section 236 B.5.f.

Cases:

Nolan (1995) 626 NYS2d 568 (The court prefers that the custodial spouse remain in the family home until the youngest child of the marriage turns age 18.)

Mitzner (1994) 619 NYS2d 51 (preference for custodial parent to remain in the home).
