New York Law - Contributions or Efforts

The issue of spouse contributions to separate property arises most frequently in the following situations:

  • A spouse who comes into a business the other spouse had started.
  • A spouse who contributes to a mortgage on a home the other spouse had purchased.
  • A spouse who makes physical improvements to a home owned by the other spouse.

In these cases, the court tries to figure out how much of the value is attributable to the other spouse's efforts.

That value from the non-owner spouse's efforts is marital property (not the separate property of the non-owner spouse).
