Ohio Law - What Are Some Examples of Spousal Support Awards? Here are some examples of spousal support awards. Cases: Peck (1994) 645 N.E.2d 1300 (The parties had IRAs, credit union accounts, bank accounts, and a house with equity of about $95,000. The court essentially divided the property in half. It also awarded $250 a month in spousal support for two years. The husband's annual income was approximately $46,000, and wife's annual income was approximately $29,000. The husband received an interest in various employer-sponsored pension plans which were not available to wife through her employer, and the wife had only a high school education while the husband had at least two years of college). Soley (1995) 101 Ohio App 3d 540, 655 NE2d 1381 (The wife was a native of Hungary. The couple had one child, who was grown and out of the house. The marriage had lasted for 20 years. The wife was in her mid-50's, and was qualified only for unskilled or semi-skilled work due to her lack of fluency in English. The wife received approximately 55% of the marital property. The court ordered the husband to pay permanent support of $2,000 per month, subject only to her death, remarriage, or cohabitation.) Simoni (1995) 657 N.E.2d 800 (Husband and wife had been married for 29 years. They had no children. The assets were worth about $3 million. About $1.4 million was the value of the husband's business. The remaining assets, much of it in cash were worth $1.6 million. The court divided all the assets 50/50. The trial court awarded the wife, in addition to these assets, alimony sufficient to give her a $100,000 annual income for the next seven years. (After that, her social security plus investment income would reach $100,000.) The appeals court held that this was too much. The appeals court said that the goal of alimony is to provide necessary sustenance. Although alimony is to be based on the former standard of living, it is not required that the alimony assure that the woman could enjoy her former standard of living. Kahn, (1987) 536 N.E.2d 678 (The wife was awarded alimony of $12,000 a year, for one year only. She received $119,000 as her share of the property division. She earned about $20,000 a year. Her husband was a doctor who earned about $130,000 a year.)
