Ohio Law - How is Goodwill Counted?
Cases here describe how business goodwill is calculated.
Cases:
Kahn, (Ohio App. 1987) 42 Ohio App.3d 61, 536 N.E.2d 678 (In this
case, the husband was a doctor earning about $130,000. The wife was
a nurse earning about $20,000. The court found, as part of the
property to be divided in the case, goodwill in the husband's family
medical practice of $68,000. A portion of this $68,000 was assigned
to be paid by the husband to the wife. The court found that
including the value of goodwill was proper. This was so even though
the husband would also be paying alimony out of income he earned from
the practice. The court noted that it is often the case that
income-producing assets, such as securities and real estate, are
divided in the property-settlement phase, and then relied upon to
produce income for alimony in the alimony phase.)
