Ohio Law - Are Any Debts Chargeable To the Other Spouse? The situation most frequently arises where, after separation but before divorce, the wife runs up debts in her own name (not on the husband's credit card). The wife then can't pay the debts, and the creditors want to collect from the husband. In Ohio, the creditors are out of luck. Having relied on the wife's credit in making the loan or supplying the goods, they may not go after the husband, even though the divorce is not final. However, Ohio has a statute that gives either spouse the responsibility to pay the debts of the other spouse for "necessaries" for the spouse or children. For the spouse, this responsibility extends any time up to the divorce. For children, it generally extends until the later of the date the child reaches age 18 or graduates high school. If the child is essentially self-supporting and living on his or her own, the obligation might end when the child starts living on his own. "Necessaries" usually means food, lodging, and necessary medical care. Section 3103.03(C),(D).
