Ohio Law - What Factors Affect the Spousal Support Amount?

Here are the factors the court considers in granting spousal support:

  • The income of the parties, from all sources;
  • The relative earning abilities of the parties;
  • The ages and physical, mental, and emotional conditions of the parties;
  • The retirement benefits of the parties;
  • The duration of the marriage;
  • The extent which it would be inappropriate for a party, because of custody of a minor child of the marriage, to look for work outside the home;
  • The established standard of living during the marriage;
  • The relative extent of education of the parties;
  • The relative assets and liabilities of the parties including any court-ordered payments;
  • The contribution of each spouse to the education, training, or earning ability of the other party, including the contribution of any party toward the acquisition of a professional degree by the other party.
  • The time and expense necessary for the spouse who is seeking spousal support to acquire education, training, or job experience so that the spouse will be qualified to obtain appropriate employment, if the court thinks it appropriate for the spouse to go to work.
  • The tax consequences for each party of an award of spousal support
  • The lost income production of either party that resulted from that party's marital responsibilities.
  • Any other factor that the court finds to be relevant and fair.

In determining spousal support, each party is considered to have contributed equally to the production of marital income.

In general, spousal support is not lifetime (so-called 'permanent'), but of a limited duration.

Also, the court figures out the property division before figuring the spousal support.

The court may grant spousal support in terms of monthly payments, or as a lump sum, in property or money, payable all at once or in installments.
