Ohio Law - May Separate Property Be Divided?
The judge may order that separate property be given to the other party. If the judge does so,
he or she must explain in writing why this was done.
Typically, the distribution of separate property does not affect the
overall property division. The judge simply distributes some
separate property such as cash instead of some piece of marital
property such as an ownership share in real estate.
Section 3105.171(E), (F), and (G), and especially Section 3105.171(E)(1).
