Ohio Law - When Can Child Support Awards Be Modified?
Child support awards in Ohio may be modified upon a "substantial change" in the
circumstances of either party.
If the amount calculated under the guidelines is more than 10% different than the
current payment amount, then a "substantial change" in circumstances has occurred.
Cases:
Schulte (1996) 1996 WL 723530 (where payer earned $3,200 monthly tax-free income, wife earns $7.00 per
hour with no retirement benefits, wife is 57 years old, new co-habitant lives on $425 a month,
and marriage lasted 26 years, support was granted despite cohabitation).
