Ohio Law - What is the 'Separation Date' The separation date is generally the date of the final hearing of the divorce or separation case, but the judge may use another date if that would be more fair. Often the date of the actual permanent physical separation is used. Another common date is the date the marriage ended in fact. Section 3105.171(A). Cases: Landry (1995) 663 NE2d 1026 (The referee had picked a date for valuing the marital home that was not any of the usual dates, and the referee had not explained why she chose the date she did. The appeals court said that referee had to explain the date she chose.)
