Pennsylvania Law - Cases Involving Business Assets Here is a case involving the division of business assets. Cases: MacAleer (1999) The couple were married for 18 years and separated in February, 1992. Starting in August 1992, and over the next 3 1/2 years, the husband exercised stock options with a net after-tax profit of almost $450,000. The wife argued that this $450,000 was marital property. Thus, she argued, she should get a share. Not surprisingly, the husband argued that this $450,000 was his separate property. The court agreed with the wife, and awarded her a share of the $450,000. The judge reasoned that the options were payment for services already rendered to the employer during the marriage. That is because the option plan was a plain vanilla plan that did not contain any language about being compensation for future services. Thus it did not matter that the options were actually exercised after the separation.
