Pennsylvania Law - Must The Payer Keep The Children On His/Her Health Insurance?

The court's order in the divorce case will always attempt to provide for health insurance for the children.

If the non-custodial parent has health insurance available at work (or otherwise) at a reasonable cost, the court will order that the non-custodial parent put the children on the health plan.

If the noncustodial parent can not pay, the court may order the custodial parent to provide health insurance.

In a shared-custody situation, the court will order one or both parents to provide coverage, depending on their relative financial situations, and the cost and nature of the coverage available.
