Pennsylvania Law - Disability Benefits If a spouse becomes disabled and is receiving disability benefits, the question arises as to whether those benefits are separate property of the spouse who is receiving them, or whether they may be divided in the divorce. We have not found law or cases on this issue in Pennsylvania. In a number of other states that have similar systems to Pennsylvania, disability benefits for which the premiums were paid during the marriage, are marital property that may be divided.
