Pennsylvania Law - Personal Injury

Whether money received on account of personal injuries is marital property depends on when the injury took place.

If the injury took place during the marriage, the money is marital property, regardless of when the money is received.

If the injury took place before the marriage or after the date of final separation, the money is the separate property of the injured party.

However, if the money is to compensate for lost wages that would have been earned before marriage or after separation, then that money is separate property of the injured party.

Section 3501.

Cases:

Warner (1993) 19 Pa. D. & C.4th 378 (money for workers compensation claim was for lost wages occurring after separation, so it was separate property).
