Pennsylvania Law - What Are The Grounds for Divorce

Pennsylvania has both fault-based and no-fault grounds for divorce. By far the most used today are the no-fault grounds.

Under no-fault, if both parties agree, the court can grant a divorce if:

  • The parties both state that the marriage is irretrievably broken; and
  • 90 days have elapsed from the date of filing for divorce;

If the parties do not agree to the divorce, the court can grant a divorce if:

  • The parties have lived separate and apart for a period of at least two years;
  • After a hearing, the court agrees that the marriage is irretrievably broken.
