Pennsylvania Law - What is the "Separation Date"? The separation date is generally the date one party leaves and does not return. Cases: Schmidt v. Krug (1993) 624 A.2d 183, 425 Pa.Super 136 (The court determined that the separation date was the date that the wife handed the separation papers to the husband, several months before the divorce was granted. Although the wife claimed that the separation date was about a year before the divorce, the court found that the parties continued to engage in activities they had engaged in during the marriage. The parties continued to invest in real estate, and although the property was titled solely in the wife's name, the husband participated in the selection, negotiation, renovation, and improvement of the property. The wife also purchased a savings bond several months before the divorce, listing the husband as a beneficiary. Finally, the wife made use of the parties' joint checking account up until a few months before the marriage. The parties had been married for 4 years, but the marriage was never consummated. The wife was aged 59 and the husband 65 at the time of the divorce.)
