Pennsylvania Law - Can One Party Alone Bring About a Divorce? One party can bring about a divorce. While the parties, if they agree, can obtain a divorce in just 90 days, one party can get a divorce after a two-year separation. The law provides that the judge must also agree that the marriage is irretrievably broken, but in practice judges never force the couple to stay together where one party has fulfilled the two-year separation requirement. Section 3301(d).
