Pennsylvania Law - The Home If the couple own the home jointly, then after the divorce, if both still have ownership interests, either party can force the home to be sold and the proceeds divided. However, the court may award to one of the parties the right to stay in the home . In that case, the other party may not force a sale. Section 3502(c), 3508.
