Pennsylvania Law - Must The Payer Keep The Spouse On His/Her Health Insurance? Under COBRA (the Consolidated Omnibus Budget Reconciliation Act of 1986), if your spouse's employer has 20 employees or more, your spouse's employer must allow you to have a policy with its health insurer for 3 years after the divorce. If the payer has health insurance available at work (or otherwise) at a reasonable cost, the court will order that the payer put the spouse on the health plan and pay the premiums. In other cases, the court may still order the payer to pay all or a portion of the recipient's health care costs. Section 4324.
