Texas Law - Will the Court Award Temporary Alimony Before Divorce? The court may award payments for the support of either husband or wife until a final decree is ordered. Section 3.59. Cases: Grossnickle (1996) 935 SW2d 830 (temporary spousal support ends when the divorce is final. In this case, the divorce was granted in 1992. The wife appealed the property division and other issues. There was a retrial in 1994 of those issues, and an appeal of that retrial that was held in 1996. The court concluded that the wife was entitled to receive spousal support only until the divorce in 1992, not during the other appeals.) Garduno (1988) 760 SW3d 735 (temporary support ordered to protect dependent spouse). Eikenhorst (1988) 746 SW2d 882 (court was allowed under Texas statute to order the continuation of spousal support during the appeal of the couple's property settlement).
