Texas Law - Life Insurance On the Payer. It is unusual in Texas for a spouse to name an ex-spouse as a beneficiary on a life insurance policy, although a judge may order it. Actually, to the contrary, life insurance beneficiaries are usually re-named so the ex-spouse is not the beneficiary. Section 3.632. Cases: Jeffcoat (1994) 886 SW2d 567 (court could not order husband to obtain term life insurance policy in the face amount of at least $13,689, payable to wife without first determining insurability of husband and cost of policy. The husband was at the time 61 years old, receiving social security disability, and had heart problems.).
