Texas Law - When Can Child Support Awards Be Modified? Child support awards may be modified whenever there is a substantial change in circumstances. Typical changes include a substantial increase or decrease in the income or expenses of either party, or of the child. The question is, if child support were recalculated, would a significantly different result apply? If yes, then a court would modify the child support order. Section 156.401. Cases: Hamer (1995) 906 SW 2d 263 (Since the divorce, the three children had grown from 4-8 year olds to two teenagers and one pre-teen. They had higher expenses for clothes, sports, and orthodontia, among other things. The husband operated an automotive business, which the husband claimed generated virtually no profit. The court based his ability to pay on a $12.00 an hour job the husband had earlier held as an auto mechanic, and alternatively on the husband's testimony about actual income from the business and payments from his new wife's parents. The court found that an increase in support from $180 to $367.50 per month was appropriate.)
