Texas Law - Physical custody

The parent who has physical custody at any moment is called "the conservator who has possession" or "possessory conservator" in Texas.

Custody can take the form of sole physical custody or some form of shared custody or visiting arrangement. In Texas's terminology, either the parent at the child's primary physical residence or a parent the child visits is a "possessory conservator" when the child is with that parent.

This parent has the following rights, unless limited by court order:

  • The right to direct the moral and religious training of the child.
  • The duty of care, control, protection, and reasonable discipline of the child.
  • The duty to support the child, including with food, clothing, shelter, and medical or dental care not involving an invasive procedure (such as surgery).
  • The right to consent to a medical or dental care not involving an invasive procedure.
  • The right to consent for the child to medical, dental, and surgical treatment during an emergency involving immediate danger to the health and safety of the child.

Texas encourages both parents to have substantial and ongoing contact with the children.
