Texas Law - Physical custody The parent who has physical custody at any moment is called "the conservator who has possession" or "possessory conservator" in Texas. Custody can take the form of sole physical custody or some form of shared custody or visiting arrangement. In Texas's terminology, either the parent at the child's primary physical residence or a parent the child visits is a "possessory conservator" when the child is with that parent. This parent has the following rights, unless limited by court order:
