Texas Law - Can the Court Order Marriage Counseling? The court may order counseling, in its discretion, both for the marriage, and to resolve issues of custody. Also, if there are children, the court will order both parties to attend a parenting course. The course may be between 4 and 12 hours in length, may be given by videotape, and may not cost more than $100. The two spouses will not have to attend at the same time. Any information that comes out in the parenting course may not be used in the trial. The idea is to encourage people to look at themselves honestly, and aim to become better parents, as opposed to positioning themselves for a courtroom. Sections 3.54, 105.009, 153.010.
