Texas Law - How Long Must You Live In the State? In order to bring an action for a divorce in Texas, one party must have lived in the state for at least six months. Military stationing in Texas counts as living there for this purpose. You must also have lived for 90 days in the county where you are filing. This 90-day requirement is designed to encourage parties to file in the county where they live, not in some other county where the judges may be more favorably inclined to one's position. If one spouse meets these requirements, either spouse may file for divorce in that county of Texas. Sections 3.21, 3.23, 3.24.
