Texas Law - What is the "Separation Date"? In some states, the separation date is a critical marker. In those states, income earned and debts incurred after the separation date are the separate property of each party and may not be divided in the divorce. In Texas, the separation date does not appear to have this legal significance. Instead, the key date is the date of divorce. As a result, there are no laws or cases that define exactly what the "separation date" is.
