Texas Law - Can Separate Property Become Marital Property Without a Gift? Separate funds that are mingled with community funds may become community property, even if the spouse does not say anything about a gift. Example: Tarzan and Jane get married. They put Tarzan's $12,000 and Jane's $5,000 saved before the marriage into a joint checking account. During the marriage, they deposit their paychecks into the joint account. They use that account for everyday expenses and for a down payment on their home at Hollywood and Vine. At the divorce, the court probably will find that neither Tarzan nor Jane is entitled to get the initial deposits back. The value of the bank account will be found to be community property and divided 50/50.
