Will the Court Award Temporary Spousal Support Before Divorce? In virtually every state, courts will award spousal support pending the divorce settlement. That is, while you are arguing over who gets the children and who gets the furniture, one spouse may have to be paying some support for the other spouse and children. The legal term for this is support "pendente lite" which is Latin for "while the litigation is pending."
