Professional Degrees One question that sometimes arises is whether a professional degree, such as a law degree or a medical degree, itself constitutes property which may be divided. If yes, then a newly-minted doctor might find herself responsible to pay to her spouse part of the six-figure "value" of her brand new medical degree. In most states, professional degrees are not marital property. However, the courts typically do take into account the increased earnings potential of a party who has recently completed a professional degree. The court may also take into account the benefit a spouse rendered by putting another spouse through professional school, as well as the cost to the homemaker spouse in terms of education or career advancement.
