Attitudes Toward Custody

A majority of states prefer sole physical custody. These states emphasize the current widespread belief that a stable home environment is very important for the child's development.

Some courts also observe that joint (or "split") physical custody tends to force the parents back into each other's lives, and results in fighting and continued litigation more often than does sole custody.

A few states prefer joint physical custody, emphasizing that it is good for children to have as much ongoing contact with both parents as possible.
