Factors In Awarding Joint Custody
Typically, a court will want to see the following factors present before
the court will award joint physical custody.
-
Both parents want joint physical custody.
-
If the child is of a certain age (12 or older, for example), whether the child prefers joint physical custody.
-
The parents will be able to work together in the best interests of the child.
-
The parents will be able to resolve their disputes concerning the day-to-day welfare of the child.
-
The parents will live close to each other, and the child will be able to attend school conveniently.
-
The parents can afford the extra costs that are typically involved in joint physical custody. (There
is a greater need for "two sets of everything" and often there are greater transportation costs.)
