When Can Child Support Awards Be Modified?

Child support awards may typically be modified whenever there is a significant change in circumstances.

This usually happens when one party or the other has a big jump or decline in income. (If the payer's income declines voluntarily, that's usually not grounds for a modification.)

Some states set a numeric threshold, saying that they will only recalculate child support if the new guideline result differs from the old guideline result by, say, 10% or more.

Other situations which may call for modification of custody include:

  • The custodial parent behaves in an inappropriate sexual manner with a new boyfriend or girlfriend in front of the children.
  • The custodial parent's new boyfriend (or girlfriend) is abusive to the children.
  • The custodial parent has a mental breakdown.
  • The custodial parent is extremely uncooperative in allowing visitation.
