Prenuptial Agreements

Prenuptial agreements are generally valid and enforceable.

However, like any contract, a court may ignore a prenuptial agreement if there was fraud to induce the party to sign. That means that if one party lied to the other party to get him or her to sign, then the court might invalidate the prenuptial agreement.

One key question is often whether both parties fully disclosed their financial situations prior to signing. The one who did not disclose will have a harder time enforcing the contract.

Also, some courts will invalidate the contract if the other party did not understand what he or she was signing, or signed it "involuntarily."

In a few states, a court may also decline to enforce the contract if, in light of subsequent developments, it would be unconscionable to do so. These cases generally involve huge, unexpected changes (in either direction) in the financial well-being of the parties.
