Is There a Minimum Waiting Period After Filing? Most states have a minimum waiting period between the time a petition for divorce is filed and the time a divorce may be granted. (A petition for divorce is the piece of paper you submit that officially asks for a divorce.) This is known as a "cooling off" period. Its purpose is to give people a chance to decide that they do not want to be divorced after all. A typical waiting period is 60 days, although there are states with no waiting periods, and states where the waiting period is effectively a year.
