Property Division in Community Property State Here is an example of property division in a community property state. This case, in which the parties' name was "Hug," was decided in California in 1984. Hug (1984) 201 Cal Rptr 676: A stock option may be viewed as compensation for past, present, or future services, based on the situation. Stock options were granted before separation but were exercisable after. In this case, the court said that the community property portion of stock options was # days married-and-employed / # days employed up to first exercise date of the option. The remaining portion of the options is separate property. Other California cases have different results on this issue.
