Family Law Software has created its own proprietary alimony calculator.
This calculator synthesizes the best of several sources, including:
- States’ rules where statutes or local rules provide for the calculation of spousal support;
- The AAML (American Academy of Matrimonial Lawyers) proposal for alimony calculation; and
- Theoretical writings about spousal support in law reviews and journals.
What did we come up with?
The basic calculation takes 30% of the payer’s income and subtracts 20% of the recipient’s income, creating a formula like that of many states’ calculators.
Then it adds the following features, which gave you the ability to customize the calculator to the situation:
- The ability to easily change those percentages in a particular case.
- Nine lifestyle factors, such as parties’ ages, health, income, etc., with + or – checkboxes which you can use to adjust those percentages.
- The ability to decide whether you want to use the parties’ pre-tax or after tax income.
- A guardrail to prevent excessive spousal support: the recipient’s income after spousal support will not be more than 40% of the parties’ combined incomes.
