California Joint Petition for Divorce: A Better Way to Start a Cooperative Family Law Case 

In 2026, California introduced a significant update to its divorce process. Couples can now file a joint petition together. This new option makes it easier for couples who have reached or are working toward an agreement to move forward together. Divorce court forms have been structured in a way that can unintentionally set an adversarial tone in collaborative and cooperative divorce cases. The first party to file is labeled as the Petitioner, while the other “receiving” party becomes the Respondent. The required summons and formal service of process often ring the bell signaling the start of a legal battle, even when both parties intend to cooperate.

  • Flexibility on Resolution: Couples do not need to resolve every issue before filing. They simply identify the matters they intend to work through. The parties can submit a final agreement when ready or continue negotiating.
